Mayor Says Carriage Hills Item to be Delayed

Mayor Pat Geagan advises members of the public that an item which had been scheduled for the November 15 City Council meeting concerning the Carriage Hills Golf Course and a possible settlement agreement regarding litigation was rescheduled for a meeting to be held November 29 at 5:30 p.m.

The Mayor recommended that the City Council delay action on a possible settlement agreement of the Carriage Hills lawsuit to allow time for a neighborhood group to review findings of a private consultant they retained.   The neighborhood group is interested in seeing if it can acquire the golf course privately and asked the City to delay making a decision on whether to enter in to a settlement agreement with Wensmann Realty, Inc., an Eagan developer which has an option on the property.

In August of 2004 the City Council denied a plan by Wensmann to rezone golf course land to develop the 120 acre property into 480 housing units south of Yankee Doodle Road and east of Lexington Avenue, but the developer sued and won at the District Court level.  The City appealed to the Minnesota Court of Appeals in May of this year.  However, attorneys from both sides were reported to have developed a possible settlement agreement for the City Council to consider.

The City has not yet received the proposed settlement agreement; if signed by the developer, a copy will be presented to the City Council on the date selected for the continuance.  Upon the adoption of the agenda tonight, the Council will decide the specific date to take up the matter again.  The Eagan Web site will be updated once this information becomes available.
