No Decision Yet on Carriage Hills Appeal

On April 28 a Dakota County District Court judge ruled against the City of Eagan and in favor of the owners of the Carriage Hills Golf Course who want to see the 120-acre site developed with 480 housing units.  The judge ruled that the City must either change its comprehensive guide plan to allow the development or begin proceedings to take the golf course through a condemnation process known as eminent domain in which the owners would be compensated for their property.

After an executive session with its attorneys on Tuesday, May 17, the Eagan City Council issued the following statement:

"The Eagan City Council has met now on three occasions in extensive closed sessions as we try to determine whether the City should appeal the lower court's ruling in favor of the proposed developer of the Carriage Hills property.  The public should understand that there are significant consequences and impacts to any of the City's options that need careful analysis before a course of action is determined."

"Given that degree of complexity, the City has added an additional attorney to its team and is working diligently to determine its course of action as soon as possible.  The City has 30 days from the date of the judge's ruling to make its decision, which would be the last week of May."
